WHO SHOULD BE A COMPENSATION ANALYSIS?
Federal law requires that compensation paid to fiduciaries (“disqualified persons”) of tax-exempt organizations should be “reasonable”, meaning that the amount of compensation should be comparable to amounts “that would ordinarily be paid for like services by like enterprises (whether taxable1 or tax-exempt) under like circumstances”. 26 C.F.R. § 53.4958-4(b)(ii). That means churches must begin to put much more effort into determining compensation for their pastors and church staff.
